About these terms
This website, daymarkconstruction.com, is operated by Daymark Construction, a residential remodelling company working in Savannah, Georgia. In these terms, "Daymark", "we" and "us" mean Daymark Construction, and "you" means anyone using the site or exchanging messages with us.
By using this site you agree to these terms. If you do not agree with them, please do not use the site.
These terms take effect on the date shown at the top of this page. They cover the website itself and the text messages we exchange with you. The Messaging Terms further down, under the heading "Messaging terms (SMS)", form part of these terms and apply whenever you give us a mobile number.
Nothing on this site or in these terms is legal, professional or technical advice. Decisions about your house should be taken with the appropriate professionals and, once you have one, with your signed agreement in front of you.
Using the site
The site exists to show the work we do and to let you start a conversation about a project. You may read it, share links to it, and send us an enquiry.
Please use it lawfully. Do not attempt to interfere with the site or the services behind it, do not try to gain access to anything not intended to be public, do not harvest data from it by automated means, and do not submit information that is false or that belongs to someone else.
You must be at least 18 years old to send us an enquiry or to ask us to contact you.
Our content and photographs
The text, photographs, video, drawings, layout and design of this site, together with the Daymark name and mark, belong to Daymark Construction or are used by us with permission. They are protected by copyright and trade mark law.
You may view the site, print a page for your own reference, and link to it. Without our written permission you may not copy, republish, sell, adapt or redistribute any part of it. Without our written permission you may not use any part of it to train a machine learning model.
The photographs show real projects. Please ask before using one.
Names, logos and marks of suppliers, manufacturers and other companies shown on this site belong to their respective owners. They appear to say what we buy and fit. They do not imply that those companies endorse, sponsor or are partnered with Daymark.
Nothing here is an offer or a contract
Everything on this site is general information about the kind of work we do. It is not an offer and it is not a contract. Nothing on it is a commitment on scope or schedule, and nothing on it creates a binding agreement between us.
Sending an enquiry, booking a call, or exchanging messages with us does not oblige us to take on your project, and does not oblige you to proceed.
We only carry out work under a written agreement signed by both of us. That agreement sets out the scope, the schedule, the terms and any warranty on our workmanship. If anything on this site differs from your signed agreement, the agreement is what counts.
Accuracy of project information
We try to keep the site accurate and current, but details change. Services, materials, suppliers, the areas we cover and the way we work may all change without notice, and the site may contain errors or omissions that we correct as we find them.
Portfolio pages describe projects as they were built. Every house is different. What was possible in one project is not a promise about yours, because scope, structure, site conditions, drawings, permits and inspections all differ from one house to the next.
Links to other websites
We sometimes link to other websites, including suppliers, manufacturers, and services we use for scheduling or forms. Those sites are not under our control.
We are not responsible for their content, their availability, or how they handle your information. A link is not an endorsement. When you follow one, their terms and privacy policy apply, not ours.
Availability of the site
We provide the site as it is. We cannot promise it will always be available. We do not guarantee that it will be uninterrupted, error-free, or free of anything harmful, and we may change, suspend or remove any part of it at any time without notice.
Parts of the site rely on third-party services such as hosting, forms, scheduling and messaging. Those services can be unavailable or can fail, and we do not control them.
If something on the site matters to you, do not rely on it alone. Call or email us and we will confirm it.
Limitation of liability
To the fullest extent permitted by law, Daymark is not liable for any indirect, incidental, special or consequential loss arising out of your use of this site, your inability to use it, or your reliance on anything published on it.
This section is about the website. Our responsibility for construction work is a separate matter, dealt with in the written agreement for your project and under the law that applies to that work.
Nothing in these terms limits or excludes any liability that cannot lawfully be limited or excluded.
Governing law
These terms, and any dispute arising from them or from your use of this site, are governed by the laws of the State of Georgia, without regard to its conflict of laws rules.
You agree that any such dispute will be brought in the state or federal courts located in the State of Georgia, and you consent to the jurisdiction of those courts.
If any part of these terms is found to be unenforceable, the rest of them continue to apply.
How these terms change
We may update these terms from time to time, for example when the way we work changes, when a service we rely on changes, or when the requirements of mobile carriers or our messaging provider change.
When we do, we will post the revised terms on this page with a new effective date. The current version always lives here. Continuing to use the site after that date means you accept the revised terms.
If we make a material change to the Messaging Terms below, we will make that clear.
Messaging terms (SMS)
Messages are sent by Daymark Construction LLC, a residential remodeling company in Savannah, Georgia. This section sets out the terms for those messages. It applies whenever you give us a mobile number or send us a text, and you should read it before agreeing to receive messages from us.
Program description: we send conversational text messages about an enquiry you have sent us or a project we are carrying out for you — confirming a visit, answering a question, letting you know we are on our way. We do not send promotional or marketing texts.

Who sends the messages, and what they are for
Text messages are sent by Daymark Construction, a residential remodelling company in Savannah, Georgia. They are sent from a number we operate, through the customer relationship and messaging platform we use to run the business.
We use text messages to reply to an enquiry you have sent us, to arrange and confirm a time to talk or to come and walk the house, to ask and answer questions about your project, to tell you when we are arriving, and to let you know if something about your schedule changes. In short, they are part of a conversation you started.
We do not currently send promotional or marketing text messages. If that ever changes, we will ask for your agreement to those messages separately, and we will update this page before sending any.
These messages go to the mobile number you gave us. Only give us a number that is yours. Do not give us someone else's number without their permission.
How you give consent
You consent to receive text messages from us when you give us your mobile number and agree to be contacted by text. That happens in one of three ways: you tick the consent box in the chat widget on this site, you text us first, or you give us your number and ask us to text you. The enquiry questionnaire does not collect consent to text — a phone number given there is used to call you back.
The box on the contact form is never ticked in advance, and the form works whether or not you tick it.
However you give it, we record your consent — the number, the date and time, and how it was given — and we keep that record for as long as we hold the number. If you give us your consent by telephone, we send you a text confirming it before we send you anything else.
The first message we send confirms your consent. It names Daymark Construction, says what the messages are for, and tells you that message frequency varies, that message and data rates may apply, and that you can reply STOP to opt out or HELP for help.
Consent is yours to give and yours to withdraw. You may withdraw it at any time, in the way set out under "How to stop the messages" below.
You must be at least 18 years old and the owner of the number, or authorised to use it, to consent to receive messages from us.
Consent is not a condition of purchase
Agreeing to receive text messages is not a condition of purchasing anything from us, of any work we do for you, or of getting a reply from us.
If you would rather not receive texts, say so. Email us at info@daymarkconstruction.com or call (912) 500-6565 and we will use those instead. It makes no difference to whether we take on your project or how we handle it.
Message frequency
Message frequency varies. You will only receive texts in reply to the enquiry you send us; we do not send messages on a fixed schedule, and we do not send promotional or marketing texts.
How many you receive depends on the conversation and where your project has got to. Arranging a first visit might take a handful of messages over a few days. During a build there may be more. In between there may be none at all.
If the volume is not what you want, reply STOP and it ends.
Message and data rates
Message and data rates may apply.
Any such charges are set by your mobile carrier under your own plan, not by us. If you are unsure what your plan includes, check with your carrier.
How to stop the messages
Reply STOP to any message from us at any time. We also recognise END, QUIT, CANCEL and UNSUBSCRIBE.
When you do, we will send one final message confirming that you have been unsubscribed. After that confirmation we will not send you any further text messages, unless you ask us to start again.
If you want messages again later, reply START, or simply text us, or tell us and we will set it up.
Opting out of text messages does not cancel any agreement between us, and it does not stop us replying by email or telephone if you have asked us to contact you that way. If you would like us to stop contacting you entirely, email info@daymarkconstruction.com or call (912) 500-6565 and tell us.
If replying STOP does not appear to work, email or call us on the details above and we will take care of it.
How to get help
Reply HELP to any message from us and we will reply telling you who we are and how to reach us. We also recognise INFO.

Delivery, carriers and devices
Text messages depend on your mobile carrier, your device and your service at the time. Delivery is not guaranteed.
Mobile carriers are not liable for delayed or undelivered messages.
We cannot guarantee that a message will reach you, or reach you promptly, and we are not liable for any message that is delayed, undelivered, or delivered to the wrong number because a number was given to us incorrectly or has since changed.
Do not use text messages for anything urgent or safety-related. If something on site is urgent, call us on (912) 500-6565. In an emergency, call the emergency services.
Please tell us if your mobile number changes.
Privacy
Mobile information and SMS consent will not be sold, rented or shared with any third party or affiliate for marketing or promotional purposes.
No mobile information is shared with third parties for their own purposes. We share it only with the service providers that operate our messaging and enquiry handling, and only so that they can provide that service to us.
We use your mobile number to contact you about your enquiry and your project, as described above. We do not sell your personal information.
